Your written project agreement sets the scope, price, payment schedule, and any project warranty. An online inquiry or estimate appointment does not, by itself, authorize painting work.
1. About these terms
These Terms apply to tbpainting.co and its use in contacting Two Brothers Painting ("we," "us," or "our"). Please read them with our Privacy Policy, Legal Disclaimer, and Warranty & Refunds page.
Services are governed by the estimate, proposal, contract, approved change orders, and other written terms accepted for your project (your "project agreement"). The project agreement identifies the contracting business and controls project-specific matters if it differs from these website terms, subject to applicable law. These pages do not change an existing agreement retroactively.
2. Estimates and project approval
We provide residential and commercial painting and related services described on our Services page. Availability and suitability depend on the property and the work requested.
A request, website description, calendar appointment, or preliminary discussion is not a final price or a commitment to perform work. Estimates reflect the scope and conditions evaluated. Refer to the written estimate for its validity period, included work, materials, exclusions, and acceptance requirements.
Requested additions or conditions discovered during preparation may require a revised scope, price, or schedule. Any resulting change is subject to the project agreement and approval process; this page does not authorize an undisclosed charge.
3. Scheduling and property access
Work dates are confirmed for each project. Weather, drying conditions, material availability, unsafe conditions, or other circumstances may affect the schedule. Any adjustment remains subject to the project agreement and applicable law.
Customers should provide accurate project information, permission for the work, and agreed access and utilities. Follow the preparation instructions for your project, including protecting or moving personal belongings and keeping children and pets clear of work areas. Tell us about known leaks, damaged surfaces, hazardous materials, access restrictions, and other conditions relevant to the work.
4. Deposits and payments
Deposit amounts, payment milestones, due dates, and any authorized fees are established in the project agreement or applicable invoice. This website does not create a standard deposit, late fee, financing arrangement, or automatic charge authorization.
Use the Pay Invoice page only for an invoice or payment you recognize, and check the amount before submitting. The embedded payment provider processes the transaction under its applicable terms. Contact us promptly about a duplicate payment, incorrect amount, or billing concern. See Warranty & Refunds for requests relating to cancellations or refunds.
5. Calls, email, and text messages
When you contact us about a project, we may respond using the contact information you provide. Service communications can include estimate follow-up, appointment details, project updates, and billing information.
Marketing messages are subject to applicable consent requirements. Consent to marketing is not a condition of purchasing services. For text messages, frequency varies and message or data rates may apply. Reply STOP to stop text messages, or contact us for help. Use an email's unsubscribe option or contact us to stop marketing emails. Opting out of marketing does not cancel your project or prevent necessary non-marketing communications through an available channel.
6. Appropriate website use and ownership
Use this website lawfully. Do not submit misleading information, impersonate another person, send malicious files, attempt unauthorized access, or interfere with the website or its users. Only provide information or photographs you have authority to share.
Website text, design, photographs, logos, and other materials belong to Two Brothers Painting or their respective owners and licensors. You may use the website to evaluate our services. Republishing or commercially reusing protected material requires the rights holder's permission, except where the law permits otherwise.
7. Website information and third-party services
We aim to keep information current, but availability, descriptions, or other details may need correction. Confirm important project details in writing before relying on them. The website and third-party features may experience interruptions; contact us by phone or email if a form or payment tool is unavailable.
External websites and service providers have their own applicable terms and privacy practices. To the extent permitted by law, we do not guarantee uninterrupted or error-free access to this informational website. Any project-specific warranty or liability terms belong in the project agreement. Nothing here excludes responsibility or remedies that cannot lawfully be excluded, including applicable protections concerning fraud, willful misconduct, or gross negligence.
8. Questions, governing law, and updates
Contact us with a concern so we can review the relevant project information. This request does not prevent you from using a legal remedy, contacting a regulator, or exercising a payment-dispute right.
Colorado law governs these website terms to the extent permitted by applicable law, without taking away mandatory protections that apply to you. If a provision cannot be enforced, the remaining provisions continue to the extent lawful. Updates are identified by the date above and apply prospectively; a website update alone does not modify an existing project agreement.
